Welcome to WeCanvas. These Terms of Service ("Terms") govern your access to and use of the WeCanvas website at ourcanvasspace.com and the WeCanvas application (collectively, the "Service"), operated by WeCanvas ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service. By using WeCanvas, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

3. How WeCanvas Works

WeCanvas provides private digital spaces ("canvases") where invited members can share photos, text updates, and moments. Canvases are designed to be simple, private sharing spaces — there are no public comments, likes, or follower counts. Content shared on a canvas is visible to all members of that canvas.

4. Invitations and SMS Consent

Canvas members may invite others to join a canvas by sharing a secure invite. The invited person opens that invite, signs in or creates a WeCanvas account, and then enters the phone number they personally use and chooses whether to enable SMS for themselves. No family member can opt in on behalf of another person. No content messages are sent to a phone number until the phone owner directly opts in. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP.

5. User Content

You retain ownership of all content you post to WeCanvas ("User Content"). By posting content, you grant WeCanvas a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Service to you and other canvas members.

You are responsible for all content you post. You agree not to post content that:

• Violates any law or regulation
• Infringes on the intellectual property rights of others
• Contains harmful, threatening, abusive, or harassing material
• Contains malware, viruses, or other harmful code
• Is spam, deceptive, or misleading

We reserve the right to remove content that violates these Terms.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to access other users' accounts or private canvases without authorization
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service without our permission
• Collect or harvest information about other users without consent
• Send unsolicited messages or invitations through the Service

8. Intellectual Property

The Service, including its design, features, logos, and branding, is owned by WeCanvas and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Third-Party Services

WeCanvas integrates with third-party services including Supabase (data storage), Telnyx (SMS delivery), Google (authentication), and Netlify (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss of data or content.

12. Limitation of Liability

To the maximum extent permitted by law, WeCanvas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Service.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
